Terms of Use


1. Introduction

1.1 General Overview: These Terms govern the use of the Plantlogy app provided by us. By downloading, installing, or using the App, you agree to these Terms. If you do not agree with any of these Terms, you must refrain from using the App.

1.2 Legal Agreement: This is a binding agreement between you and [Your Company Name], and by accessing or using the App, you agree to these Terms of Service. Apple Inc. is not responsible for the App’s content, features, or its use, nor is Apple responsible for any claims related to the App.

1.3 Apple’s Role: Apple is not a party to these Terms but merely acts as the App distributor through the App Store. All concerns regarding the App’s content and functionality should be directed to Plantlogy.

2. Use of the Plantlogy App

2.1 Eligibility and Device Requirements: The App is available for iPhone, iPad, or other Apple devices running iOS 14 or later. You must ensure your device meets the compatibility requirements for the App, including the necessary hardware specifications and operating system version.

2.2 Account and Registration: To access certain features of the App (such as plant identification), you may need to create an Apple ID. Your Apple ID is subject to Apple’s Terms and Conditions, and any data linked to your account will be processed in accordance with Apple's Privacy Policy.

2.3 Family Sharing: If you are a family organizer, you can share your purchased content (such as premium features) with up to six family members using Apple’s Family Sharing feature. All purchases and features shared with family members are subject to the same usage restrictions outlined in these Terms.

2.4 Availability of Content: The availability of plant data, identification services, or other features may vary depending on geographic location or content licensing agreements. Some features may not be available in your country or region.

3. Payments, Purchases, and Subscriptions

3.1 Free and Paid Features: The App may provide both free and premium features. Free features may be subject to limitations in functionality or usage, whereas premium features will require an in-app purchase or subscription.

3.2 In-App Purchases: In-app purchases may be available, such as subscription plans (monthly, yearly), premium features, or removal of ads. You can view the pricing details on the App Store page before purchasing. Charges for purchases are processed via Apple Payments and billed to your Apple ID. 

3.3 Subscription Details: Subscriptions are auto-renewing unless canceled. If you subscribe to premium features, you will be billed automatically at the start of each billing cycle. If you do not wish to continue the subscription, you must cancel it before the next billing cycle.

3.4 Refund Policy: Refunds for purchases made through the App should be requested through Apple. Please refer to Apple’s Refund Policy for guidelines on how to request a refund.

4. Privacy, Data, and Security

4.1 Personal Data: By using the App, you agree that we may collect and process certain personal data in accordance with our Privacy Policy. This may include:

  • Your email address (for account creation and communication purposes)
  • Usage data (how you interact with the App)
  • Plant-related data (such as uploaded images and identified plant information)

4.2 Third-Party Data Sharing: If the App integrates third-party services, such as plant databases or image recognition services, your data may be shared with these third parties. These third parties are responsible for their own privacy policies.

4.3 Family Sharing Information: If you use Family Sharing, some of your data may be accessible to family members. For example, the family organizer can view subscription activity and purchase history.

4.4 Data Security: We will take reasonable steps to secure your data, but we cannot guarantee complete security. Any data breach notification will be provided in accordance with applicable laws.

5. Restrictions on Use

5.1 Usage Restrictions: You are granted a personal, non-exclusive, and non-transferable license to use the App for personal, non-commercial purposes. You may not:

  • Sell, redistribute, or sublicense any part of the App.
  • Attempt to reverse engineer, decompile, or disassemble the App’s code.
  • Use the App for illegal activities or any purpose that violates these Terms.

5.2 Prohibited Content: You may not upload or submit any content to the App that:

  • Violates intellectual property rights
  • Is obscene, defamatory, or offensive
  • Contains harmful or malicious software (malware)

6. Updates and Maintenance

6.1 App Updates: The App may require regular updates to ensure functionality and security. Updates will be automatically installed unless you opt-out in the device settings. Some updates may introduce new features or modify existing ones.

6.2 Support: We provide customer support for the App, and any issues or bugs can be reported via the App Support section on the App Store.

7. Termination of Access

7.1 Account Suspension: If you violate these Terms, we reserve the right to suspend or terminate your access to the App, including access to any purchased or subscribed content. In such cases, you will not be entitled to any refund unless required by law.

7.2 Deletion of Account: You can request to delete your account and associated data at any time. Upon deletion, your access to premium features, if applicable, will be terminated.

8. Disclaimers and Limitation of Liability

8.1 Warranty Disclaimer: The App is provided "as is," without any warranties of any kind. We do not guarantee that the App will be error-free or free from interruptions.

8.2 Limitation of Liability: We are not liable for any indirect, incidental, or consequential damages that may arise from your use of the App, including any loss of data or profits.

9. Governing Law

These Terms are governed by the laws of the country where the app is being used. If you are located in the United States, the laws of the state in which the app’s provider is incorporated apply.

10. Changes to Terms

We may update these Terms at any time. If material changes are made, users will be notified via the App or other communication channels. Continued use of the App after changes are made will constitute your acceptance of the new Terms.
